Property sells “as is, where is”. Purchaser is responsible for his/her own due diligence. Announcements made auction day take precedence over printed material. No liability for accuracy, error, or omissions is assumed by the Seller or the Auction Companies for information contained in the brochure or other advertising and is subject to verification by potential bidders. Confirmed bidder will be required to sign a contract of purchase and submit the nonrefundable ten percent (10%) escrow deposit at conclusion of bidding. A four percent (4%) buyer’s premium will be added to the confirmed bid to constitute the final contract sale price. Display fixtures, counters, shelving, racks not included. Tax map not to be used as a survey, provided for location purposes only. In the event of default by the Purchaser, said escrow deposit shall be payable to the Sellers as liquidated damages. This provision shall not preclude the Sellers from pursuing any other legal or equitable remedy against the Purchaser, although Purchaser shall be entitled, in such event, to have the escrow deposit credited against the Sellers’ damages otherwise recoverable. Real Estate taxes for 2017 will be prorated as of closing between Purchaser and Sellers. All prior years real estate taxes are the expense of the Sellers and shall be paid by the Sellers at closing if not previously paid. Sellers will be responsible for the required grantor’s tax and deed of conveyance. Purchaser shall be responsible for all other expenses required to close the transaction to include points, title search/insurance, attorney’s fees, recording fees, survey, and related expenses as may be required by Purchaser’s lending institution if applicable. Sellers shall provide a warranty deed free and clear of all liens and encumbrances, exceptig easements, zoning, encroachments, rights-of-ways and restrictions of record to the extent that they may lawfully apply. It is the responsibility of the Purchaser to obtain a title examination at his/her own expense, should the title not be marketable, Sellers will take necessary steps to remedy marketability. County/city ordinances and zoning may apply. Possession at closing upon dellivery of deed within thirty (30) days. Property is being sold subject to confirmation. However, sellers reserve the right to declare the auction absolute at any time up to and during the auction.
